1. Acceptance of Terms

By accessing and using MyQuickSite ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service ("Terms") govern your access to and use of the MyQuickSite website and service operated by us ("we," "us," or "our"). By using our Service, you agree to comply with and be bound by these Terms.

2. Description of Service

MyQuickSite is a web-based service that allows users to create and publish one-page websites at myquicksite.co/{slug}. The Service includes:

  • Website creation and editing tools
  • Image hosting for portfolio items
  • Customizable themes and layouts
  • Public hosting of your published site
  • Account management and dashboard

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept all responsibility for activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

3.2 Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to comply with this section.

3.3 Account Termination

You may delete your account at any time through your dashboard. Upon account deletion, all associated data, including your published sites, will be permanently deleted and cannot be recovered.

4. User Content and Conduct

4.1 Content Ownership

You retain ownership of all content you create, upload, or publish through the Service ("User Content"). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display your User Content solely for the purpose of providing the Service to you.

4.2 Content Responsibility

You are solely responsible for your User Content. You represent and warrant that:

  • You own or have the necessary rights to use and authorize us to use your User Content
  • Your User Content does not violate any third-party rights, including intellectual property, privacy, or publicity rights
  • Your User Content complies with all applicable laws and regulations
  • Your User Content is not defamatory, libelous, or otherwise harmful

4.3 Prohibited Content

You agree not to use the Service to create, upload, or publish content that:

  • Is illegal, harmful, threatening, abusive, or discriminatory
  • Violates any intellectual property rights
  • Contains malware, viruses, or other harmful code
  • Is spam, fraudulent, or misleading
  • Violates any applicable laws or regulations
  • Infringes on the rights of others
  • Contains explicit or adult content without appropriate warnings

5. Prohibited Uses

You agree not to use the Service:

  • In any way that violates any applicable law or regulation
  • To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
  • To impersonate or attempt to impersonate us, our employees, another user, or any other person or entity

The Service and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent. All other trademarks, service marks, and trade names are the property of their respective owners.

You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.

7. Slug Availability and Usage

Slugs (the unique identifier in your site URL) are subject to the following rules:

  • Slugs must be 3-30 characters long
  • Slugs may only contain lowercase letters, numbers, and hyphens
  • Slugs cannot start or end with a hyphen
  • Certain slugs are reserved and cannot be used (e.g., admin, api, login, signup, pricing, terms, privacy, dashboard, settings, support)
  • Slugs are assigned on a first-come, first-served basis
  • We reserve the right to reclaim or reassign slugs that violate these Terms or are inactive for extended periods

8. Service Availability

We strive to provide a reliable and accessible Service, but we do not guarantee that the Service will be available at all times. The Service may be unavailable due to:

  • Maintenance and updates
  • Technical issues or failures
  • Circumstances beyond our reasonable control

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service
  • Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, FOR ACCESSING THE SERVICE, OR $100, WHICHEVER IS GREATER.

10. Indemnification

You agree to defend, indemnify, and hold harmless us and our officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with:

  • Your access to or use of the Service
  • Your violation of these Terms
  • Your violation of any third-party right, including any intellectual property or privacy right
  • Your User Content

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or delete your account through your dashboard.

All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE MAKE NO WARRANTY THAT:

  • THE SERVICE WILL MEET YOUR REQUIREMENTS
  • THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
  • THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE
  • THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

14. Governing Law

These Terms shall be interpreted and governed by the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the Service and supersede all prior agreements and understandings.
